Besides resolving problems as soon as possible, equally important is to do this effectively. Too often, cases drag on and stumble in court. We are committed to trying negotiation, mediation and arbitration to resolve disputes, taking into account the positions of regulators, businesses and residents in a particular problem. This may avoid the need for legal proceedings or may result in an agreed form of abatement notice. Court proceedings can then be resorted to when other approaches have not worked.
Examples include:
- resolving problem cases using Alternative Dispute Resolution methods such as mediation and arbitration
- while acting for the local authority, negotiating solutions with defendant companies in order to avoid court proceedings
- acting for companies to settle the terms of notices with local authorities
- preparation of cases for review by the Ombudsman
- providing technical and legal advice, including drafting abatement notices
- providing expert reports and expert witness in court hearings
